15 It is a rare owner of intellectual property who will allow broad fair use practices to be written into fair use guidelines. Therefore, fair users will always be challenging rights holders either to ignore the purported infraction or to bring them to task for it. Guidelines will be helpful to users whose actions must fall on this side of caution and to owners who need a bright line to tell them when not to pursue unlicensed uses. But guidelines are not laws, so ultimately, it is up to the user to determine when to manifest the conviction that his or her claim of fair use is justified—guidelines or no.
